Acceptance of Terms

By hiring equipment, the Hirer automatically signifies their unconditional acceptance in whole of the terms as set out in this Terms & Conditions of Hire.

By providing the information required on the booking form, paying or making a deposit or showing their acceptance to hire equipment or services by phone, written or electronic communication, the hirer agrees to be bound unconditionally by these Terms & Conditions of Hire.

Terms and Conditions of Equipment Hire

These terms apply to the equipment hire (i.e. hire of equipment and operation by the hirer). 

1. Ownership.All hired equipment remains the property of Cleersoundz PA Hire. A hirer may not sell, lease, lend, sub-hire or dispose of the equipment.

2. Condition of Equipment. Where equipment is used without our supervision, we check the condition and operation of all items before they leave us. On accepting delivery you agree that an item is in good condition and fully operational.

3. Hire Periods. All equipment must be returned or made available for collection at or before the time agreed. For each day or part day it remains outstanding a hirer may otherwise be charged the greater of the daily hire rate for each outstanding item, or the sum of direct and consequential losses attributable to its late return. Equipment must be returned by the date and time agreed. A charge of the full published daily hire rate will be made on every item for every day or part day that return is overdue.

4. Use of Equipment. It is a hirer's responsibility to ensure hired equipment is suitable for the purpose. All equipment is used at the hirer's risk. We do not accept liability for any costs or claims arising from a hirer's use of our equipment. On taking delivery of an item, a hirer accepts responsibility for its functional and electrical safety, and for ensuring it is used correctly, safely and legally. Anyone appointed to operate or supervise equipment must be competent to do so (and must have received appropriate training where required by circumstance or law). Equipment may only be used within manufacturer guidelines. All equipment should only be used in a clean, dry, well-ventilated place, using only safe (i.e. earthed and breaker-protected) regulated 230V AC power sources. Any misuse of hired equipment by a hirer or hirer's appointee entitles Cleersoundz to its immediate recovery without notice or penalty.

5. Equipment Failure. All equipment we supply is electrically safe, fully operational, and in good condition. All our equipment is also of professional standard and well-maintained. Modern equipment is very reliable. Catastrophic equipment failure is therefore unusual and unlikely. However, we cannot accept liability for any direct or consequential losses arising from equipment failure. In the event of an apparent fault, no repair should be attempted without prior reference to and the express consent of Cleersoundz PA Hire.

6. Lost or Damaged Equipment. A hirer is liable to us for the whole cost of any loss of or damage to equipment (including damage to cases or containers), however this is caused. Where an item cannot be repaired or replaced before we need to use it again, the charge for loss or damage will include the cost of hiring a temporary replacement. A hirer will be charged (at the rate of £30.00 + VAT per hour or part hour) for cleaning equipment that is returned in a damp or dirty condition.

7. Exclusivity and Variation. Other terms and conditions may apply to any agreement you have with us (whether or not they form part of any written statement), and the above terms do not apply exclusively. Any variation must be specifically agreed by Cleersoundz in writing. These terms take priority over any agreement where no other written statement exists.

8. Charges. The Hirer will pay the full or the outstanding amount before the hire date or upon completion of the setup. Where the equipment is left in the possession of the Hirer over for more than 24 hours the Owner may require the Hirer to pay 10% of the value of the equipment supplied by way of deposit such sum to be refunded at the termination of hiring by the Owner to the Hirer after the deduction of any monies due by the Hirer to the Owner under this agreement.

9. Penalties. Any equipment returned after the booked return date will be charged for at a minimum of one extra days hire fee, regardless of the original hire period.

The Owner is authorised by this contract to contact the hirer at the hirer’s premises at any time in the recovery of equipment not returned at the end of the hire period.

Cleersoundz PA Hire will check the equipment and inform the hirer within 7 working days of any loss or damage. Any costs incurred to the Owner in respect of replacement or repair, or if equipment is lost or damaged during the hire period must be met by the Hirer.

The hirer undertakes to keep and return equipment in good order and the same condition as provided at the point of hire. Any equipment returned in a soiled or dirty condition may incur a cleaning charge.

Equipment is to be kept in a secure safe environment with no exposure to the elements, food, drink or other liquids. Should the Hirer not adhere to this then the Owner reserves the right to charge the hirer for any damage.

Connectors must not be removed from equipment. The Owner reserves the right to charge for refitting or inspecting any connectors found to have been removed, or tampered with. Equipment must not be modified in anyway.

Failure to return any cable(s) may result in a charge for replacing the said cable(s).

Packaging supplied with equipment must be returned, or it will be charged for.

The Hirer will be held liable for the full loss of any equipment confiscated because of a failure to comply with any relevant laws and regulations.

If the hirer reports any equipment or accessories as faulty during a hire which are then subsequently found to be in good working order, the hirer will be liable for all costs incurred for dealing with the situation including but not limited to the replacement equipment hire charges (for the full period of hire), sub-hires, purchases, labour and transport in any form.
